Blizzard countersues WoWGlider

On October 25th, Blizzard/Vivendi payed a personal visit to Michael Donnelly, creator of WoW Glider and accused him of violating the DMCA. Their demands were unclear, but come in the wake of recent player bannings for using bots in the popular MMORPG. It looks like he's going to fight it, but I think it'll be an interesting case if it ever reaches the courts."

>From the post: "The visitors from Vivendi / Blizzard made demands of Michael and stated that if the demands were not met that they would file a complaint in court if he did not meet them. I asked Michael what the demands were. He was unable to comment at the time to the exact details. But I do know they handed him a copy to very briefly 'Look at'. He was not given a copy. I think I could make a good guess and say that they asked for Glider to be shut down and if they feel that they have been harmed they may have asked for a financial settlement."

    This is quite funny, the entire situation tickles me.

    A judge is going to toss it out of court and then should promptly smack everyone involved for wasting the time of the court.

    Why are Vivendi and Blizzard Delaware companies yet they both reside in California?

    Is this a common practice I'm not aware about? (ie lower takes in Delaware?)

    People who code tools like this and people who use those are scum and need to be removed from the game. They also need to pay for the illegal profit they make off of other people's hard work.

    You'll find that the majority of US companies or their affiliates are incorporated in Delaware for the reason stated below, their laws are more inclined towards the companies there.

    What about if Michael was outside of the US? Say in Asia, or Europe? (I'm just curuious, I wouldn't know anything about it :P)

    Actually, Blizzard does have an actionable case here, and it looks good on their behalf. (This is from a former paralegal.) The main issue is the interference in the contract IMO. But the WoWGlider seller making money off a program that violates the Terms of Use is another possible actionable. I think that the court of law will actually support Blizzard in this. (And this is the first GOOD use of the DMCA that I have ever seen!!!!)

    Regardless of how this pans out in court (IF it even makes it there) it should scare enough people out of using glider to make this worth Blizz's while.

    So, basically anyone who is smarter then you is scum?

    I personally don't see how this is anywhere close to DMCA infringement.

    This is like me making a windows program. OMG I'M GOING TO BE SUED I USED THIS ON WINDOWS OS. The courts have no clue what they are doing as far as copyrights on software. RDX is basically a pay for addon why doesn't blizzard sue them.

    Making glider isn't against the blizzard's code of conduct, nor can it be forbidden by it. What can be done is sue the people using glider, not the creator (this is coming from a Dutch law student).

    This case is about infringment of copyrights which isn't really the case here.

    i partialy agree with you, those people that do it for a profit should be banned form playing but the people that do it for them selves and not for profit should be let off.

    i reckon they might just say, "Your having a *** about a video game? get a life", and throw it out of court LOL... i mean there are more pressing matters in the world than some people bending the rules in a game, and thats all it is realy.

    Tthis is just Blizzard/Vivendi trying to Rule The World again rofl.

    I hope blizz loses, just so there will be precedent for many others to take action vs them or not be afraid to take them head on. Yes apply directly to the forehead blizz bitches!

    Then we can start the disassembling of their grand puba eula and eventually they will have no rights to anything and stfu.

    Last I checked they were not masters of the universe.

    Anyway I vote against blizz!

    Blizzard has absolutely no case. Read all the legal documents before you post. This isn't a matter of personal opinion, it's a matter of law. In which case, Blizzard has a horrendous base to work with. Your opinions on the character of the creator or the users of a program have no purpose.

    I hope Blizzard has this guy shut down. All wowglider seems to accomplish is destroying the games economy and helping cheaters to cheat. I like the game but I don't want to play it if I have to keep my account logged in with a bot farming, leveling, playing the game for me just to afford gear and items. Its not the capabilities of his program as much as the ethics in which its used and sold to his customers. Wowgliders sole purpose was to allow people to not play the game and get the same result at actually being at the computer and putting in the time. Anyone who supports this and thinks that it has a place in the MMO world needs to take a closer look at themselves and see that what they're doing is wrong and destroying the game for everyone else.

    In the end it would all come down to who has the best script playing their character while they are away. Imagine logging into a server where all players are afk for hours on end farming, killing your mobs you need for a quest and selling level 30 green items for 100 gold because the market is saturated with gold. If you want this then go play on one of the hacked servers with your bot, and keep it out of our realm.

    I would compare wowglider to someone walking into a casino with a card counting computer strapped to their leg. Ethically the same, but the difference being that wowglider directly affects the innocent consumers of the game in terms of the play experience.
