Blizzard countersues WoWGlider

On October 25th, Blizzard/Vivendi payed a personal visit to Michael Donnelly, creator of WoW Glider and accused him of violating the DMCA. Their demands were unclear, but come in the wake of recent player bannings for using bots in the popular MMORPG. It looks like he's going to fight it, but I think it'll be an interesting case if it ever reaches the courts."

>From the post: "The visitors from Vivendi / Blizzard made demands of Michael and stated that if the demands were not met that they would file a complaint in court if he did not meet them. I asked Michael what the demands were. He was unable to comment at the time to the exact details. But I do know they handed him a copy to very briefly 'Look at'. He was not given a copy. I think I could make a good guess and say that they asked for Glider to be shut down and if they feel that they have been harmed they may have asked for a financial settlement."

A collection of all the legal documents filed by Blizzard can be found here!

@FRRjak Michael is actually pretty built. He's almost a millionaire. And his girlfriend is smoking hot. Nice try, though.

Does everyone blindly agree with concepts without thinking anything through?

I'm undecided on the issue, but legally, Blizzard has no case.

well i am totally against cheaters of all forms and the fact the guy has created a tool which destroys the games market and he is making a profit from it thats quite wrong no matter what way you look at it. he only good reason that could have been involved with wowgliders creation would have been educational purposes nothing more.

@Xvelocity "Michael is actually pretty built. He's almost a millionaire. And his girlfriend is smoking hot. Nice try, though."

Still the fact remains, he's an *** that has ruined the game for thousands of people, for personal profit. I wish there was something I could do to strengthen the case against him. In the meantime, all I can do is report all the bots I see.

The majority of botters use bot programs to skip the mundane task of leveling that they have done numerous times. They don't use it to farm massive gold. They don't do it exploit the economy. Look to farmers for those mistakes. People want to blame the American/European botting community so quickly but they really have no concept of what the average botter does. Producing software that enables people to skip the 1-60 grind that they have done countless times is a blessing to those that use it. I'd consider it but my character has way too many /played days to even think of risking it. When I see botters, I just run past them. It takes time to report that I could be playing and they aren't causing me any harm at all. And when you think about it, they don't hurt you either.

    @ Xvelocity

Most of the ppl that using this program will use it to get gold. Maybe not to sell it, but still its destroy economic. Every fall down start with small step. Let me just lvl my char with bot, lets get some gold to buy this... its newer stop. When number of ppl using bot rise its will become nessery to USE bot to play WoW. More and more spot will be filled with bots, ppl wont be able to do quest or take extremly long time to do quest becouse quest mobs are farmed by bots and you cant move to next quest becouse this mobs are farmed as well.

Sorry but using cheating to get easy gold do rise sell prise on AH.

So its affect other ppl in 2 way: Hard to find mob for quest/drop and need to pay more for items on AH. With increase of ppl using bot program this effect will rise.

Let me first start by saying that I in no way condone nor like botting in WoW...however

I have read much about this case since I first came across MSY suit against Blizzard some monthes ago. I knew it was only a matter of time before Bliz filed their answer/counter-suit. Blizzard's case, unfortunately, is very weak and is pretty much doomed for the get go. It is gonna be extremely difficult for Bliz to show that MDY either violated their copyright (their botting software doesnt use any of Blizzards code, it merely uses programming to control WoW thru natural keystrokes and scripting) or that MDY caused them any monatary loss (bot or no bot, Blizzard still collected their monthly fee). You got to remember that yeah MDY created the software but they never forced anyone to use it. However, I'm sure Bliz already knows that it is a BS lawsuit, but not counter-suiting who have been worse then doing so a losing.

@Xvelocity: Take a look at the wowglider forums, and you will get a hunch of just how many ARE selling their gold. Quite a few, actually. And as to "The majority of botters use bot programs to skip the mundane task of leveling that they have done numerous times." this is cheating just as everything else the software does. If you're not man enough to play your own character, get lost. We don't want you here. Place your bot-*** on a private server somewhere and leave the true gamers alone.

Are you kidding? First of all that's quite the ironic point of view. The entire game is built on people levelling their characters to 60, if you are not willing to play the character then what are you earning? That's like getting a drivers license for a vehicle which drives itself. Producing software to do anything else than assist a player in normal playing is downright wrong. It's cheating, and WoW is not the kind of game that honest people can tolerate cheaters with, because it affects so much. Doesn't hurt anyone? I beg to differ. So here is "Farnus" the level 50 warrior in UnGoro, playing the game as he should, taking his time, doing his quests, killing his mobs....and out of the blue here comes "Braze", the lvl 60/70 mage who is killing everything in the area (including Farnus quest mobs) for essence of etc. No way, you have some kind of naive way of thinking that tries to justify that it is right to bot, leading me to suspect that you do (but that's another story). At the end of it all, botting in any realtime online mmorpg is wrong. And contrary to what you may think, it DOES hurt honest players....whether these botters are selling gold or not, because in the end you're not earning your level 70, to getting it for almost nothing vs. honest players who spend dedicated time and energy to play the game. I sincerely hope that blizzard sues the white out of this guys eyes just to make an example to anyone else intending to make botting software. And I hope they ban every last character botting in WoW.

    Cheaters should NEVER prosper.
