On September 29th Blizzard Entertainment won part of their case against MDY Industries -- makers of the now infamous WoW Glider bot program -- to the sum of $6 million USD. This is a monumental win for Blizzard, as it cements the EULA as something that can hold up in court as a binding contract between the developer of a game and the consumer.
The first win against MDY Industries came in July of this year when US District Court Judge David Campbell ruled that WoW Glider -- now known as 'MMOGlider' -- broke the terms of the EULA which players must agree to before being able to play World of Warcraft.
Michael Donnelly -- creator of MMOGlider -- reportedly sold more than 100,000 copies of the bot program for $25 USD, totaling more than $2.5 million in earnings for something that is illegal in the game according to the EULA. Now Donnelly will have to give all of that back and then some, thanks to this ruling. Hopefully now he finally understands the saying "cheaters never win."
Blizzard Entertainment and MDY Industries will be back in court on January 8th, 2009, according to this filing record, and we'll be sure to bring you any further news related to the trial as it happens.
