(This is from a former paralegal.)  The main issue is the interference in the contract IMO.  But the WoWGlider seller making money off a program that violates the Terms of Use is another possible actionable.  I think that the court of law will actually support Blizzard in this.  (And this is the first GOOD use of the DMCA that I have ever seen!!!!)

&lt;/p&gt;&lt;p&gt;I personally don't see how this is anywhere close to DMCA infringement.
&lt;/p&gt;&lt;p&gt;This is like me making a windows program. OMG I'M GOING TO BE SUED I USED THIS ON WINDOWS OS. The courts have no clue what they are doing as far as copyrights on software. RDX is basically a pay for addon why doesn't blizzard sue them.

&lt;/p&gt;&lt;p&gt;Making glider isn't against the blizzard's code of conduct, nor can it be forbidden by it. What can be done is sue the people using glider, not the creator (this is coming from a Dutch law student).
&lt;/p&gt;&lt;p&gt;This case is about infringment of copyrights which isn't really the case here.
