In theory, yes. But if the pet is too high for you to kill, then you won't survive long enough to tame it.

No you can not tame a beast that is above your level. it must be your level or lower. If you are a much higher level than your pet that you tame it will automatically level up to five levels below you unless it is within that range then it will keep its current level.
